Pursuant to the Personal Data Protection Law No. 6698 ("PDPL"), your personal data listed below will be processed by our Company in its capacity as the Data Controller, in connection with business purposes, in the manner described below, including using, recording, storing, updating, transferring and/or classifying such data. In this context, our Company, in accordance with the Law and Regulations enacted to protect the fundamental rights and freedoms of individuals, particularly the privacy of private life, and to protect personal data, takes all appropriate technical and administrative measures to ensure an appropriate level of security in order to prevent the unlawful processing of your personal data, prevent unlawful access, and ensure their protection.
The personal data you have provided to us and specified below shall, in all circumstances; the personal data we have obtained in the manner specified below as appropriate, within the scope of our legal relationships,
Within the scope of our commercial relationships or within the context of our business relationship with you, within the framework of the purpose requiring their processing and in a manner limited and proportionate to this purpose, shall be recorded, stored, preserved, reorganized, while maintaining the accuracy of personal data as notified to us or as notified, shared with institutions authorized by law to request such personal data, and under the conditions envisaged by the Personal Data Protection Law (hereinafter referred to as "PDPL"), transferred to, assigned to, classified by and otherwise processed in the manner listed in the PDPL by third parties within or outside the country, and we hereby notify you.
The target audience of this text includes natural person employer customers of our Company engaged in commercial relationships, their employees and natural person representatives/employees of our legal entity employer customers, natural person suppliers – business partners – external service providers and natural person representatives of legal entity suppliers-business partners-external service providers. Personal data processed in the capacity of Data Controller is provided below, not limited to those specified here;
Identity Data; Name, surname
Contact Data; Telephone, email, company name
Method and legal basis of processing personal data
As a Company, to fulfill our legal obligations, to perform the contract within the scope of the commercial relationship between our Company and/or you and us, and due to our Company's legitimate interest, for reasons arising from the law, we collect personal data that we request from you and/or other representatives/employees acting on behalf of your company, through transmission to us by you and/or other representatives/employees of your company in physical or electronic form or through cameras in physical or electronic form.
Purpose of processing personal data
Your personal data may be processed by our Company for the purposes and legal reasons specified below, but not limited to these purposes and reasons. Your personal data will be retained for the period specified in the legal regulations to which we are bound in order to protect our field of activity and legitimate interests.
- Creating offers within the scope of commercial relationships,
- Preparing contracts within the scope of commercial relationships,
- Ensuring communication in the context of commercial relationships,
- Invoicing within the scope of financial obligations,
- Maintenance of Financial Affairs records,
- Management of payment processes,
- Provision of communication regarding matters such as goods delivery and transportation,
- Determination of the address where the goods or services will be delivered,
- Budget management and reporting,
- Provision of communication among suppliers, business partners, external service providers and customers,
- Obtaining support from supplier employees,
- Quality control and evaluation relating to service/contract performance,
Sharing of Your Personal Data with Third Parties Domestically and Internationally
Your personal data may be shared with relevant public legal entities such as the Data Protection Authority, Ministry of Finance, Ministry of Customs and Trade, Ministry of Labour and Social Security, Turkish Employment Agency (İş-Kur), Information Technologies and Communication Authority, to the extent permitted and required by the provisions of the Labor Law, Occupational Health and Safety Law, Social Security and General Health Insurance Law, Law on the Regulation of Publications Made on the Internet and Combating Crimes Committed Through These Publications, Turkish Commercial Code, Law No. 6698 on the Protection of Personal Data, Identity Declaration Law and other applicable legislation, in order to ensure your security and the Company's compliance with legal obligations. For example; personal data is shared with the Tax Authority due to invoicing transactions.
Furthermore, we may share your personal data:
- With transportation companies, cargo companies, couriers and other persons and institutions for the delivery of products or goods, documents, etc. that should be delivered under our commercial relationship,
- With banks,
- We may transfer your personal data necessary for the purposes of monitoring and reporting of accounting and financial transactions such as budget management, commercial card opening, invoicing to our affiliated companies and audit firms.
- For the management of accounting and financial transactions, we may process your personal data as necessary for the relevant software used, in accordance with the processing purpose. This data may be recorded in the data storage system of the said application.
- In order to ensure that records containing your personal data are retained for the duration of the storage period, we may send the relevant records to third party archive companies providing this service.
- Furthermore, in order to exercise our right of defense, we may share with our lawyers and relevant institutions within the scope of our obligation to comply with legal requests such as court orders or requests for evidence, provided that they are in accordance with law and procedure.
Pursuant to Article 11 of the GDPR, your rights are; by applying to our Company, regarding your personal data:
- To learn whether or not it is being processed,
- Request information if processed
- Learn the purpose of processing and whether it is used in accordance with that purpose
- Know the 3rd parties to whom data is transferred domestically/internationally
- Request correction if processed incompletely/incorrectly
- Request deletion/destruction within the conditions foreseen in Article 7 of the GDPR
- Request notification to transferred 3rd parties of the operations carried out in accordance with items (5) and (6) above
- Object to a result being produced against you due to analysis solely by automated systems
- Demand compensation for damages suffered as a result of unlawful processing
In accordance with Article 13, paragraph 1 of the Personal Data Protection Law, you can submit your request regarding the exercise of your rights mentioned above to our Company in writing or by other methods determined by the Personal Data Protection Authority. The requests in your application will be concluded free of charge within thirty days at most, depending on the nature of the request. However, if the operation requires an additional cost for the Company, a fee determined in the Notification on Application Procedures and Principles to Data Controllers by the Personal Data Protection Authority may be charged.
Our Company may request additional verifications (sending a message to your registered phone, calling you, etc.) in order to determine whether the application belongs to you and thus protect your rights.
